Abstract

The power of command has always been among the prohibitions imposed on the administrative judge, whether in France or Algeria,nevertheless this situation was changed by a decisive intervention of the legislator, and for the first time in its history, the administrative judge was able to issue explicit and direct commands to the administration, with the possibility of annexing them to a penalty payment in order to obliging them to take certain measures, under fixed standards. Thus, the position and role of the administrative judge will be conforming to the requirements of legal security required in the contemporary legal state.
