Abstract
the subject of international criminal justice represents one of the most significant
developments in the trajectory of contemporary international law.
It emerged as a response to the urgent need to hold individuals accountable for
serious crimes that threaten international peace and security, such as genocide, war
crimes, and crimes against humanity.
A comprehensive system of investigation and prosecution has been developed to
ensure a balance between the effectiveness of justice and the protection of the
rights of both the accused and the victims.
However, the system still suffers from notable shortcomings, particularly in the
enforcement phase of judgments.
This is largely due to the international nature of the court, which relies heavily on
state cooperation, and its institutional dependence on the Security Council, which
can obstruct the course of justice—especially when major powers exercise their veto
rights.
