Abstract

"this dissertation examines the legal framework governing micro-enterprises in Algeria, as they represent a key instrument for promoting entrepreneurship, reducing unemployment, and supporting sustainable local development. In recent decades, Algeria has adopted several legislative and regulatory measures to encourage the creation and growth of micro-enterprises through national support mechanisms such as the National Agency for Entrepreneurship Support and Development (ANADE). The study analyzes the main legal texts regulating micro-enterprises, including their definition, classification criteria, and the procedures for establishment, support, and monitoring. It then applies this framework to a practical case study: motorcycle delivery companies, which have emerged as a modern economic activity driven by digital transformation and the expansion of e-commerce. The dissertation highlights that, despite the existence of general legal provisions, Algeria still lacks a specific and comprehensive regulatory framework for delivery services, especially those operated by motorcycle couriers. This legal gap creates uncertainty regarding licensing requirements, professional obligations, liability issues, and the legal nature of the relationship between delivery companies and riders. The study concludes that the current Algerian legal framework remains insufficient to fully regulate newly emerging activities such as motorcycle delivery services. Therefore, legislative reform and the adoption of specific regulations are necessary to ensure a balance between economic freedom, public safety, and consumer protection."
