Abstract
The Algerian constitutional founder adopts the principle of monitoring the
constitutionality of laws as an embodiment of the principle of the supremacy of
the constitution in all the constitutions known to the country except for the 1976
constitution under the name of the Constitutional Council until the last
constitutional amendment in 2020, when the latter was replaced by the
Constitutional Court as a new oversight body aimed at protecting the
constitution and strengthening the principle of separation Among the authorities,
consolidating and preserving the rights and freedoms that are constitutionally
recognized. It has also been entrusted with the task of adjudicating disputes that
may arise between the constitutional authorities, in addition to interpreting the
constitution. The Constitutional Founder also stipulated the composition of the
Constitutional Court, which retained some of the characteristics that
distinguished the composition of the Constitutional Council, and carried with it,
at the same time, special features related to the conditions of membership in it.
