Abstract

This study examined the legal framework of work accidents and occupational diseases under Algerian legislation, illustrating the hierarchy of its governing texts. The study concluded that worker protection is subject to a strict legislative hierarchy; starting with fundamental statutes, foremost among them Law 83-13, which defines the general rules for work accidents and occupational diseases, and Law 08-08 concerning social security disputes. Executive decrees implement these laws procedurally, such as Decrees 05-09 and 05-12 defining preventive measures and safety committees, and Decree 93-12 regulating compensatory aspects, down to ministerial decisions providing technical details. Ultimately, the study highlights that the efficacy of legal protection depends on the integration and compliance with this binding hierarchy.
