Résumé

"This dissertation examines medical crimes in Algerian legislation through the study of the criminal liability of healthcare practitioners and the rights of victims of medical crimes, The study shows that medical progress, despite its benefits, has led to medical errors that may affect patients, safety and lives, which required the Algerian legislator to regulate medical practice and establish legal rules for patient protection. The dissertation also discusses the concept and elements of medical crimes, forms of medical negligence, and the causal relationship between the act and the damage, It further highlights victims’ rights such as the right to compensation, complaint, and legal protection, The study concludes that Algerian legislation provides important legal protection for victims, but further development of oversight and medical expertise mechanisms remains necessary to achieve a balance between patient protection and freedom of medical practice."
