شرعية العقوبات الدولية في ظل أحكام القانون الدولي العام

Résumé

" This study centers on the legal institutionalization of the legality of international sanctions as a punitive criminal mechanism. These measures are integrated within the provisions of Chapter VII of the United Nations Charter, and are enforced in instances of threats to peace, breaches of the peace, or acts of aggression. They are directed against states, individuals, or entities associated with the violation in question. These sanctions constitute a fundamental cornerstone of the contemporary global order and are subject to stringent regulations. Some of these the ""individuality of punishment"", while others are bound by enforcement requirements, such as the prerequisite of ""legal liability"" in compliance with the provisions of international public law. In light of the foregoing, it is concluded that international sanctions form a complex and intertwined legal framework within international law. It is an independent, self-sustaining, and continuous concept designed to regulate the behavior of states and subject them to international rules upon the commission of any violation ."
