Résumé
This study examines the legal regulation of contractual negotiations as a pre-contractual stage. It highlights that negotiations are governed by the principles of good faith and freedom of negotiation rather than being merely factual. The study also shows that Algerian civil law lacks specific provisions on this stage, relying instead on general legal principles and civil liability rules. It concludes that an abusive or unjustified termination of negotiations may result in pre-contractual liability and emphasizes the need to balance contractual freedom with the protection of legitimate expectations
