Résumé

This study addresses the "Crime of Blackmail in Light of Digital Transformation" as one of the most prominent modern cybercrimes generated by the contemporary technological revolution. The study aims to clarify the conceptual framework and legal elements (legal, material, and moral) of this crime under Algerian legislation, focusing on the procedural rules governing digital search and investigation operations, as well as the admissibility of electronic evidence and its subjection to the discretionary power of the criminal judge. The study also highlights the real-world repercussions of digital transformation by identifying new types of perpetrators (amateurs, professionals, and organized groups) and victims (individuals, women, and children), presenting practical examples such as the exploitation of minors through online games and the phishing of "BaridiMob" application users. The study concludes that while current general legal texts are temporarily sufficient, there is an urgent need for a specialized law and the enhancement of the technical capabilities of investigative authorities to confront the fluid and transboundary nature of this crime
