Résumé

"Mixed marriage is a marriage concluded between two persons who differ in nationality, religion, or both. It is considered one of the issues that raises various legal and practical challenges due to the diversity of laws and legal systems. Such marriages are governed by the provisions of the Algerian Family Code in addition to the rules of Private International Law, which determine the applicable law whenever a foreign element is involved. Differences in the applicable law give rise to several legal and practical difficulties, making the registration and official documentation of mixed marriages more complex. These difficulties may also affect matters related to the filiation of children born from such marriages, as well as issues of visitation rights and child custody. Furthermore, the enforcement of foreign judgments may encounter significant obstacles. Other challenges may arise, including the expulsion or deportation of the foreign spouse after marriage. "
