Résumé

The Public Prosecutor's Office plays a pivotal role in Algerian legislation as the fundamental cornerstone for safeguarding basic rights. It holds a distinct position within the legal organizational structure and is governed by a specific set of characteristics and privileges granted to its magistrates. This study addresses the central problem of how effective the legislative reforms affecting the Public Prosecutor's Office have been in both theory and practice. This is particularly relevant in light of the new Law No. 24-15", which granted the office expansive powers in initiating public actions (criminal prosecution), managing litigation stages and rectifying judicial errors. Furthermore, the study highlights its active role in striking a balance between the interests of society and the accused's right to a fair trial, as well as resolving pending legal matters through alternative dispute resolution mechanisms outside the scope of formal judicial prosecution
