Résumé
"This dissertation addresses the topic of insurance against damages as acontract in which the insurer undertakes to compensate the insured in theevent of damage resulting from a specified risk, in exchange for a premiumpaid by the insured. The purpose of this contract is to restore the insured'sfinancial situation to what it was prior to the occurrence of the damage,without generating any profit.
The study focuses on property insurance and civil liability insurance.
The former covers the protection of property against various risks such as fire,theft, climatic hazards, and livestock mortality, while the latter coversdamages arising from the insured's liability towards third parties.
Insurance is therefore considered an effective economic and legal mechanism due to its role in alleviating the burdens resulting from unforeseen damages, in addition to providing social and legal security for individuals and institutions.
