Résumé
This study seeks to review the fundamental concepts related to artificial
intelligence, considering it one of the most prominent achievements of the human
mind and as a scientific field in the stage of emergence and accelerating and
continuous development in the present era. It is worth noting the absence of a unified
and comprehensive legal definition of AI as each jurist has adopted their own criteria
in determining its concept and defining its scope in addition to that this study
addresses the most prominent practical applications of AI across various fields,
along with verifying the determination of the scope of criminal intelligence entities
in accordance with the applicable legal provisions and principles.
Furthermore, the expanding reliance on AI technologies in various fields of
life has given rise to a set of complex legal problems, foremost among which is
criminal liability for acts emanating from these systems in this context, the
importance of research emerges in examining the extent to which Algerian
legislation -most notably the Penal Code- is consistent with this emerging
technological reality, through testing the applicability of traditional rules of criminal
liability and consequently raising the question of the possibility of attributing
criminal liability to AI systems for crimes they may commit.
