Abstract

This study examines the procedures for combating the misuse of artificial intelligence under Algerian legislation by analyzing its conceptual and legal framework and the procedural mechanisms used to detect and prosecute related offenses. The research aims to assess the effectiveness of the Algerian legal system in addressing crimes arising from the misuse of artificial intelligence, particularly in light of rapid technological developments and the increasing risks posed to individual rights, freedoms, and information security. The study adopts a descriptive and analytical approach through the examination of relevant legal texts, notably the Algerian Code of Criminal Procedure and Law No. 09-04 concerning the prevention and combating of crimes related to information and communication technologies. The study concludes that Algerian legislation provides several legal and procedural tools to address such crimes; however, there remains a need for a specialized legal framework governing artificial intelligence in order to keep pace with technological advancements and strengthen legal protection mechanisms.
