Abstract

" This study underscores the Algerian legislator’s commitment to regulating judicial notification procedures in a manner that ensures the fulfillment of their fundamental purpose—namely, to provide the parties with actual and timely knowledge of the content of a legal claim or judgment. These procedures are meticulously outlined by the legislator to safeguard the right to defense and to enable the concerned party to appear and respond effectively. In an era marked by rapid digital transformation, traditional methods of notification have become insufficient to meet the growing demands for speed and efficiency. Consequently, the legislator has introduced electronic means of notification as a complementary mechanism aimed at streamlining procedures and reducing delays. Nonetheless, it remains imperative to ensure that the notified party acquires effective legal knowledge of the notification, in order to avoid the issuance of default judgments that may undermine the guarantees of a fair trial "
