Abstract

The system of conditional release is one of the modern legal mechanisms aiming to strike a balance between the need for punishment and the impérative of social réintégration of prisoners. The algerian legislator hás given particular importance to this system within the framework of the law on the organisation of prisons and the social reintegration of detainees. Conditional release is considered a means of granting a second chance to inmates who have demonstrated good behavior and readiness to reintegrate into society. This study examinés the legal framework of conditional release in Algerian, including its material and procedural conditions, the Steps required for its granting, the authorities responsable for its supervision, and its role in reintegration. The research also analyzes the praticable implémentation of this system, highlghting the shortcomings and challenges its faces, and proposes recommandations to improve its effetiveness in line with modern Principles of restorative justice
