Abstract

"This dissertation aims to examine the topic of the husband’s rights under Algerian Family Law, considering it one of the essential pillars that govern marital relations and ensure family stability in accordance with the provisions of Islamic Sharia and national legislation. The study addressed the various rights enjoyed by the husband, which are classified into material rights — including the right to participate in the financial assets, household property and furnishings, inheritance rights, and compensation — and moral rights such as the right to obedience, guardianship, and divorce within legal and religious conditions.

The research also shed light on the organization of the financial system between spouses, whether through agreements established in the marriage contract or by subsequent official contracts, while clarifying the legal rules for dividing shared assets upon the dissolution of the marriage by divorce or death. The study concluded by affirming that ensuring both spouses’ awareness of their rights and duties contributes to achieving tranquility and stability within the family and reducing marital disputes, which have been increasingly widespread in Algerian society. It further recommends intensifying legal and social awareness campaigns to reinforce a sound family culture."
