Through our study of this memorandum, we have studied the legal situation of the foreigner in light of comparative and legislation and international agreements, in addition to Algerian law, the memorandum is divided into two chapters : The first chapter we focused on the conceptual aspect whether terminological or doctrinal or legal, In order to compare spme laws with Algerian law, also we made the difference between foreigner, the immigrant, and the stateless person that had a special and specific laws . In the second, we focused on clarifying the rights that foreigner has and the most important obligations imposed in him, we also shed lights on the legal conditions determined by the host country and the foreign state, provided that they do not violate human rights and the basic rights for the foreigner. We also addressed the analysis of the legal texts concering the foreigner’s entry and residence in a comprehensive manner, especially under law 08-11 therefore a foreigner, when residing in a country other than his own is subject different from those in his country. The legislator has imposed some obligations to preserve public order and ensure stability in addition to everything related to forced or Voluntary departure, which may represent deportation or expulsion often issued by the will of the foreign state. Law 08-11 also allows the foreigner to practice work and reside in Algeria, which depends on meeting the legal conditions. In order to combat the illegal immigration and the disorganized residence and the disorganized labours, the la 08-11 set many sentences and measures for this foreigner and their partners who went beyond the legislations.
