Abstract

The system of stopping the implementation of an administrative decision in the administrative judiciary as en exception to the general rule ( the principle of effect is not a basis for appealing the cancellation of administrative decisions ) , this system aimes to impose urgent protection of rights and freedoms, especially in the avent that the administration deviates from the principle of legality. Accordingly, we studied stopping the implementation of administrative decision in the light of the amendment to the civil and administrative procedures Law , so that this study included the field of stopping the implementation of the administrative decision, in terms of the ability of the administrative decision to be implemented, and the cases of the stopping this implementation of it also included the procedures for stopping the implementation of the administrative decision, the request including the formal and substantive conditions until the decision is made on the request to stop the implementation of the administrative decision, indicating the nature of the order issued to stop the implementation and the methods of appealing it.
