Résumé

"This research examines the legal regulations governing bank accounts under Algerian legislation, particularly Law No. 23-09 on Monetary and Banking Law. The study aims to analyze the legal rules related to the opening, operation, and closure of bank accounts, as well as the obligations and legal liability of banks toward their customers. Bank accounts represent a fundamental tool for carrying out banking transactions such as deposits, withdrawals, transfers, and payment services. The research demonstrates that the bank account is based on a contractual relationship requiring the fulfillment of the essential legal conditions of a valid contract. It also discusses the different types of bank accounts and the procedures governing their opening and closure. Furthermore, the study highlights the professional obligations of banks, including customer identification, banking secrecy, and the duty to inform and advise clients. It emphasizes the role of banking supervision in ensuring financial stability and combating money laundering. The findings reveal that Algerian legislation does not provide a comprehensive legal framework specifically dedicated to bank accounts. The study concludes with several recommendations aimed at strengthening the legal regulation of bank accounts and improving customer protection within the banking sector."
