الحقوق المالية لمرأة في قانون الأسرة الجزائري

Abstract

This research aims to highlight the financial rights of women as regulated by Algerian Family Law, examining the extent to which these rights align with Islamic jurisprudence. The researchers adopted a descriptive and analytical methodology, analyzing both legal and jurisprudential texts alongside relevant judicial decisions. The study found that women enjoy a set of financial rights such as dowry, maintenance, inheritance, bequests, and endowments; however, some gaps remain in practical application. It concludes that while the 2005 reform marked a significant advancement in securing women's financial rights, further legislative and institutional safeguards are still needed. The research underlines the importance of harmonizing Islamic principles with contemporary social developments.
