Abstract

"The aim of our study titled “PublicAuction Sale of co-owned property” is so address one of the latest forms of multiple-party ownership where several individuals share ownership in money or property without specific shares being assigned to each which is known as joint or undivided ownership this often leads to disputes regarding the sales or purchase process. Since joint ownership may give rise to multiple disagreements which can hinder mutual consent between co-owners may request division. The legislator has identified two ways to do this .amicable partition or judicial partition the latter involving a public auction process if the co-owners cannot agree on how to divide the jointly owned property they may resort to thr judiciary which will oversee its sale through auction in accordance with legal provisions . The goal here is to protect the rights of all co-owners in the sale process which is a legal and enforceable means that leads to the transfer of ownership to the highest bidder with all auction procedure regulated by the judge overseeing the process "
