Abstract

"Islam and Islamique législation have given special attention to the child from the moment of birth, surrounding him or her with a comprehensive system of rights. Among the most prominent of these rights is the right to custody, which becomes a legal issue, particularly upon the dissolution of the marital bond. The Algerian legislator has intervened to regulate this matter by identifying the persons entitled to exercise custody and clarifying the conditions that must be met by the custodian. The best interests of the child have been established as the primary criterion, prevailing over all other considerations, in order to ensure family and social stability. From this perspective, this study aims to shed light on the controls and standards upon which a judge relies in forming judgments in cases where there is an absence of a legal provision or ambiguity in matters related to child custod."
