Abstract
"Automated technologies and algorithmic programs are among the most significant outcomes of the Fourth Industrial Revolution. In light of technological and digital transformations, they have come to play a pivotal role in enhancing commercial transactions, making them a fertile ground for achieving integration and economic development. This has impacted various fields related to e-commerce, most notably electronic marketing through product discovery and the use of intelligent recommendation systems, as well as combating electronic fraud and cyberattacks by strengthening digital security and risk response.
Accordingly, artificial intelligence has been adopted in the formation of smart contracts that rely on blockchain algorithmic programs, which are distinguished by unique mechanisms of formation and execution. However, smart technologies have evolved to the extent that artificial intelligence agents can now intervene in forming electronic contracts. This raises the issue of the need to determine the legal nature of the electronic agent, which is the basis for holding it accountable for damages resulting from breaches of its contractual obligations.
This has led to various challenges regarding legal capacity and consent, resulting from the impracticality of granting such agents legal personality. As a result, there has been a call for collective efforts to find solutions and mechanisms to generalize the use of artificial intelligence technologies in e-commerce."
