dc.description.sponsorshipConsidering that custody is one of the most prominent issues in the field of the family, it is an extremely sensitive topic due to its close connection to the family, and in particular to the child who is the victim of this family disintegration. Islamic law and Algerian legislation have given great importance to it. The Algerian legislator has tried to enact a set of laws and texts, and this is through The text of Articles 62 to 72 of the Algerian Family Code in order to focus and protect the child in custody based on the principle of taking into account his interest. Interest is the essence of protection on the basis of which the judge bases his decisions. However, custody is not devoid of problems, due to the lack of clarity of vision in its texts, as it contains many defects. And the gaps and shortcomings and to what extent the judge can adhere to these texts or go beyond them and his endeavors to do so in accordance with the broad powers granted by the Algerian legislator in order to interpret the texts in accordance with jurisprudence and properly apply them judicially to achieve the best interest of the child.
