Abstract

This research examines the issue of the binding force of international law in the present time, through an analysis of its development and its theoretical and practical foundations, and then a review of the obstacles facing its implementation in the contemporary international system. It is evident that international law has evolved from a set of customs and bilateral treaties to a more organized legal system based on the principles of the United Nations, peremptory norms, and international courts. However, this development has not been sufficient to ensure effective enforcement, especially with the continued double standards and political selectivity in dealing with violations, as is the case in Palestine, Ukraine, and Western Sahara. The research also shows that the strength of the law lies not only in its texts, but also in the extent to which the major powers are committed to respecting it and activating its mechanisms in a just and balanced manner. In conclusion, a series of legal and academic recommendations were presented to enhance the binding force of international law and achieve genuine global justice .
