Abstract

"in Algerian civil law, the notion of a professional contractor introduces a distinct legal framework that sets this party apart from the average contractant. By virtue of their expertise and specialized knowledge, professionals are subject to heightened obligations that reflect the expectations of their rote in modem contractual relations. Civil liability may be incurred when the professional fails to meet specific duties such as providing clear information, offering appropriate advice, issuing necessary warnings, and ensuring the safety of others. Unlike ordinary contractors, professionals are judged against the benchmark of a competent practitioner in their field, regardless of their personal intentions. This elevated standard serves to safeguard the interests of non-professional parties, who may lack the technical knowledge to fully assess the risks or implications of a contract. As such, the civil liability of the professional contractor acts as a legal mechanism to promote fairness, accountability, and equilibrium in contractual engagements, reinforcing the principles of trust and responsibility inherent in professional conduct. "
