Abstract

We noticed from this study that there isn’t a general definition for this system. But laws’ specialists consider it as reliable system in international relationships, and it is one of the international collaboration for fighting against the international grime. This system also has some sources that govern it from the verse 38 of the principal system of international course of justice which appear in the authentic sources and are obliged compulsory and the complementary resources that countries refer to then in case of inability. Moreover, this system based on some conditions that must be followed during the handing operation witch based on subjective conditions and formal terms. This system also based on important procedures that enable the legal handing operation which appear in the procedures that must be followed by the interested countries. The handing, operation rely on some traces such as the period of handing, the place of handing ….etc After we dealt with the handing conditions, procedures, sources and traces, we showed at the end the study of the system of handing criminals under the Algerian criminal procedures law which appears in the conditions and the procedures of handing criminal in national legislation. In addition to the traces of handing and the cases that allow handing. Also, we delt with the system of handing criminals under the bilateral agreements between African countries ……etc. in addition to the mandatory force of the internationals agreements in handing criminals.
