Abstract

he advancement of science and technological development had a hand in providing a solution for those who suffer from infertility . the process shifted from alegitimate bilateral relationship between the spouses to a tripartite relationship consisting of the husband ,his usually infertile wife,and a healthy surrogate mother in whom the fertilized embryo will be implanted until the pregnancy is completed and the fetus is delivered in exchange for financial compensation . this contract gives rise to numerous religious and legal problems due to the absence of a legal ruling on the legitimacy of such contracts ,in addition to the issue of determining the lineage of the child resulting from this process which made it necessary to establish penal protection for human dignity
