Résumé
he protection of children’s rights is considered one of the most significant
issues addressed by the Algerian legislator, given the child’s vulnerable status
and need for comprehensive legal protection of both personal and financial
rights. This study examines the various forms of protection established under the
Algerian Family Code, particularly the child’s right to filiation and the traditional
and scientific methods of proving it, including DNA testing. It also addresses the
protection granted to children considering modern medical techniques such as
artificial insemination, in addition to the legal provisions governing custody and
kafala as essential mechanisms for childcare and protection.
The study further analyzes the legal safeguards relating to the child’s
financial rights through the regulation of maintenance and inheritance, as well as
the role of legal guardianship in preserving the minor’s property. It also highlights
the judicial supervision exercised by the Family Affairs Judge over financial
transactions involving minors.
The study concludes that the Algerian legislator has established an
integrated legal framework aimed at ensuring the best interests of the child,
drawing its principles from Islamic Sharia and international conventions on
children’s rights, thereby providing comprehensive legal protection for children.
