dc.description.abstractThe algerian legisltordealt with the regulation of maritime mortgages in Articles 55 to 71 of the Algerian maritime law. This memorandumains to highlight the distinctive nature of this type of mortgage,which is represented in the possibility of mortgaging the ship without the need to transfer its possession,is a contractual insurance that gives the creditor à real right over the ship . it is required to be concluded with an official document from à qualified owner, which includes marine facilities the ships under construction or owned jointly .the law compensates the ship with replacement components in the event of its loss. And The ship is legally treated like real estate,despite the fact that it is movable property, as the legislator requires its mortgage to be registered in a special registry the maritime mortgager keen the ship,while the creditor has the right to seize it in the event of mon payment . it in the event of of mon payment it also grants the creditor the right of claim and recourse against others.en_US
