Abstract

Custody is one of the most important topics that has received significant attention from Islamic law and legal texts. It constitutes one of the most important responsibilities by which the mother can care for and protect the rights of the minor ward and pursue their interests. This is because it primarily focuses on achieving the child's best interests and benefit. Custody is the upbringing and protection of those who are unable to manage their own affairs, from harm due to their limitations. Custody involves caring for their affairs, raising them, and managing their finances until they are married. For this reason, Algerian law has granted custody to the mother, as she is the most compassionate, capable, and resourceful in bearing the hardships of her children and serving them.
