Résumé
This master's dissertation examines the role of the Algerian Constitutional Court in protecting rights and freedoms under the 2020 Constitutional Amendment. It aims to assess the effectiveness of the constitutional reforms that replaced the Constitutional Council with the Constitutional Court and expanded its powers to ensure the supremacy of the Constitution and strengthen the rule of law.
The study focuses on the mechanisms through which the Constitutional Court protects fundamental rights and freedoms, particularly constitutional review of laws, the plea of unconstitutionality, and the Court's jurisdiction in safeguarding constitutional guarantees. It also analyzes the legal framework governing the Court, highlighting the most significant innovations introduced by the 2020 Constitutional Amendment and their impact on enhancing constitutional justice in Algeria.
The research adopts the descriptive and analytical approaches by examining the constitutional and legal provisions regulating the Constitutional Court, in addition to relevant legal doctrine and judicial practice. The study concludes that the establishment of the Constitutional Court represents a significant step toward strengthening constitutional protection of rights and freedoms. However, the effectiveness of this protection remains dependent on the practical implementation of the Court's powers, the consolidation of its independence, and broader access to constitutional justice.
