Abstract

The Algeria legislator has given great attention to public contracts due to their connection to the public treasury, as it has organized the process of concluding and implementing public contracts in several laws related to the subject, the last of which is Law 23/12, which gave the administration the right to choose, request bids and negotiate. In the implementation phase, the Algeria legislator granted the contracting authority several powers, including supervision and control, as well as the power to amend and impose penalties, In return, the contractor is entitled to financial compensation, compensation, and financial rebalancing of the contract .
