Résumé

This study aims to shed light on the right to self-determination as one of the fundamental principles of contemporary international law by examining its concept, legal foundations, and historical development. It also seeks to identify the main mechanisms through which this right is exercised and to highlight the role of the United Nations in promoting and protecting it. The study adopts the descriptive-analytical method through the analysis of international legal texts, United Nations resolutions, and selected case studies related to the implementation of the right to self-determination. The study concludes that the right to self-determination has become a well-established principle of international law and a recognized right within the framework of the United Nations. It has played a significant role in supporting national liberation movements and the process of decolonization. The findings also show that referendums and political negotiations are among the most important peaceful mechanisms for exercising this right. However, its practical implementation continues to face challenges due to political considerations and international power dynamics, creating a gap between its legal recognition and its effective realization in certain international cases.
