Abstract

"Blockchain is a database on which all transaction and all operations are recorded and smart contracts in themselves are contracts that are highlighted and executed automatically without the need fro an intermediary; therefore; it has become an essential elementin our contemporary life ; as contracts and legal action are easy to read legal action are easy to read and implement in an automated manner . However; the use of Blockchain and smart contracts collided with the legislative vacuum and the lack of a clear legal framework ; which did not give it the opportunity to impose itself on the scene this is due to the modernity of this technology and the reclutance to recognize it by the legislator ; of some problems related to its implementation ; including the difficulty of verifying the capacity of the contracting parties and the method of expressing their will ,as wellas the problem of enforcing it ."
