Abstract

In view of the importance of the patent as the document protecting the patent from any abuse to which it may be subjected, the Algerian legislature requires that formal and substantive terms relating to the invention must be established in itself, in particular the conditions to be followed by the inventor in order to be able to obtain the patent. The procedure for filing a patent at the national level with the Algerian National Institute of Industrial Property is to deposit, examine, register and publish the application for 12 months. However, obtaining the patent has legal implications for the author's rights, such as the right to act, and places on him a set of obligations that he cannot evade. The protection period shall be 20 years and shall be calculated at the date of deposit of the application.
