المجابهة التشريعية في مواجهة جريمة الاختطاف في التشريع الجزائري

Résumé

"Kidnapping is considered one of the serious crimes that threatens individuals’ physical and psychological integrity and affects the stability and security of society, spreading fear and panic among citizens. In view of the increasing number of victims of this crime in recent years in Algerian society, the legislator intervened through Law 20–15 relating to the prevention and combating of kidnapping crimes against persons in order to curb the spread of this phenomenon, limit it, and eradicate it. This study addressed the general provisions, including the definition, characteristics, and objectives of the crime of kidnapping, as well as the distinction between and the relationship of kidnapping with various other crimes. It also examined the substantive legal framework by identifying the elements of the crime and the criminal penalties prescribed for its perpetrators, including aggravating and mitigating circumstances. Furthermore, the study highlighted the role of the State in developing strategies to protect kidnapping victims and reviewed the measures introduced under Law 20–15, including investigative and prosecutorial procedures aimed at preventing and combating kidnapping."
