Abstract
"Electronic transactions are among the most prominent manifestations of the digital age, which has emerged from the development of information and communication technologies. These transactions rely on electronic means for the conclusion of contracts, the exchange of data, and the performance of obligations. This has raised new legal challenges, particularly with regard to their validity, evidentiary value, and the protection of data and the parties involved.
In view of the significance of these transactions and the challenges they pose, and in line with international and national legislative trends towards their regulation, the Algerian legislator has sought to establish a flexible legal framework that keeps pace with technological developments. This is reflected in Law No. 18-05 on Electronic Commerce, which governs various aspects of such transactions, and Law No. 15-04 concerning Electronic Signature and Certification, which defines the concept and functions of the electronic signature, sets the conditions for its evidentiary force, and regulates electronic certification. Both mechanisms are regarded as fundamental means of proof in the field of electronic transactions."
