Abstract

This research will examine the principle of legislative stability and its relationship to investment law, as it is considered one of the most important guarantees provided by the new Investment Law 22-18. The stability of legislative provisions serves the foreign investor and provides him with adequate legal security. Therefore, the Algerian legislator has sought to enshrine the requirement of legislative stability in successive investment legislation, leading up to Law 22-18. Therefore, enshrining and enacting the requirement of legislative stability will create an investment climate conducive to attracting investors. It will also serve to limit the role of the state as a legislative authority in amending laws between it and the foreign investor at the time of concluding a contract, in a manner that disrupts the contractual and economic balance. The more legislative stability there is, the greater the volume of foreign investment, which positively impacts host countries' ability to stimulate their economies.
