Abstract

he general family order has a reference in various texts of algerian law in order to protect the family and fortify society, and this indicats the establishment of general family order that is reflected in the peremptory rules that regulate family ties and the rights and duties imposed between its members. The judiciary also plays an important role in the development of idea of public order, as the latter preserves the basic constants that are considered to be the core of national identity, embodied within the framwork of internal relations by ensuring that the juriprudential legal rules, so that the judge has the discretionary authority to push it in relations of an international nature. Excluding forgein law that is inconsistent with the foundations on which national law is based, it is subject to national law.
