Abstract

This study aims to highlight the legal framework governing the protection of personal data in Algerian legislation by defining the concept of personal data, identifying its characteristics, examining the legal provisions regulating its processing, and analyzing the mechanisms established by the Algerian legislator to ensure its protection and safeguard individuals' rights. To achieve the objectives of the study, the descriptive method was used to present the fundamental concepts related to personal data, while the analytical method was employed to examine the legal texts governing this field, particularly Law No. 18-07 on the protection of natural persons in the processing of personal data. The study concluded that the Algerian legislator has established a specific legal framework for the protection of personal data by defining the conditions for its processing, the rights granted to data subjects, and the obligations imposed on data controllers. In addition, criminal sanctions have been introduced to address violations affecting personal data. However, the effectiveness of this protection remains dependent on strengthening monitoring and enforcement mechanisms, as well as raising awareness of the importance of personal data protection in light of rapid digital developments.
