Résumé

"This study addresses the topic of “The Obligation of Conformity in Civil Law and Consumer Protection Legislation”, with the aim of highlighting this modern legal mechanism designed to protect consumer consent and ensure the quality of goods and services. The main research problem revolves around the adequacy of the general rules of civil law in providing effective consumer protection and their ability to accommodate the specific nature of modern consumer contracts, as compared to special consumer protection legislation. The study concluded that the obligation of conformity constitutes an extension and development of traditional civil law obligations (such as the warranty against latent defects). However, consumer law has endowed it with a more stringent and protective character in order to remedy the contractual imbalance between the professional seller (or supplier) and the consumer. "
