Abstract

This study examines the independence of the National Independent Authority for Elections in Algerian legislation by analyzing the legal and regulatory framework governing it. It highlights the evolution of the electoral system in Algeria, especially after the constitutional and legislative reforms that established this authority as an independent body. It also clarifies the efforts made to enhance electoral neutrality and ensure transparency and integrity across different stages of the electoral process. Organic independence is reflected in the manner of structuring the authority and the legal and organizational guarantees granted to its members. Functional independence is manifested in the powers granted to it in supervising, organizing, and monitoring elections. The study concludes that this independence remains relative in some aspects due to its connection with state institutions.
