Abstract

The current research aims to find out the provisions of the khitbah, which are singled out by Islamic law with special provisions, especially since it is considered a preparatory period for the marriage contract on the one hand, and the Algerian Legislature has not expanded on its provisions clearly, it has included the text of Article 222 of the Family Code, which refers us to refer to the provisions of Islamic law in the event of a legislative vacuum or any ambiguity. He also touched upon the various statements of Jurists on this issue, especially those related to the cancellation of the sermon and the possibility of compensation for the injured party, whether material or moral damage Taking into account the situation in which the conditions of marriage set out in Article 9 BIS of the same law are fulfilled and the statement of the opinion of Jurists and jurisprudence on this matter.
