Abstract

"Cybercrime is considered one of the modern forms of Criminal activity, due to its connection with the technological developments occurring worldwide, which are primarily based on information and communication technologies. It has been demonstrated—through the methods by which these crimes occur, the techniques used in committing them, and the analysis of their circumstances and consequences—that they differ from traditional crimes in terms of scope, victims, and detection methods. Moreover, technology has been misused to enhance theprofessionalism of perpetrators and to make their identification and apprehension more difficult. Crimes affecting automated data processing systems are among the newly emerging crimes that are distinct from classical forms of crime in terms of their nature, subject matter, and characteristics. In Algerian legislation, crimes involving automated data processing systems include the offenses of unlawful access to and unauthorized presence in an information system, information fraud, and the destruction of automated systems. The Algerian legislator has attempted to address these crimes in line with modern legislation by amending the Penal Code through Law No. 24/06, which revised Articles 394 bis to 394 bis 3 concerning offenses against automated data processing systems."
