Abstract

"This study addresses Algeria’s new Public Procurement Law No. 23-12 of 2023, which replaces Presidential Decree No. 15-247 as part of the ""New Algeria"" reforms. The law aims to modernize public financial management by reinforcing the principles of transparency, equality, and open access to public procurement. It introduces digitalization as a core element, especially through the use of an electronic procurement portal. The thesis examines both the conceptual and legal frameworks of public procurement, highlighting the updated standards and methods for contract awarding. It distinguishes between standard procedures (such as open bidding) and exceptional cases (such as direct contracting), while also evaluating the impact of digital tools in enhancing competitiveness and accessibility.
