Abstract
"Maintaining professional confidentiality is considered a fundamental duty
of all state employees, aiming to protect both public and private interests from any
harm. The holder of the confidential information has no right to disclose
it to others. However, certain professions require access to confidential information
the core of this obligation lies in preventing public employees from disclosing
entrusted information.
To ensure this, the Algerian legislator has guaranteed the protection
of professional confidentiality and imposed penalties on anyone who violates this
obligation, whether a public employee or a professional. This reflects the necessity
of mutual trust. Violating this obligation may result in disciplinary sanctions which
could extend to criminal or civil liability to compensate affected parties
Nevertheless, exceptions are provided that allow the disclosure of confidential
information to serve the public interest without legal accountability, thereby
eliminating liability for breaching professional confidentiality."
