Abstract

"This dissertation addresses the issue of juvenile delinquency from two major perspectives: the conceptual and legal framework that defines who is a juvenile offender and the nature of their criminal responsibility, and the legal mechanisms established for their protection within correctional institutions. The research demonstrates that the Algerian legislator, in alignment with international conventions—particularly the 1989 Convention on the Rights of the Child—has adopted a specialized juvenile justice system aimed at ensuring fair trials and prioritizing rehabilitation over punishment. The study also explores the legal obstacles to juvenile advancement, compares the criminal responsibility of juveniles versus adults, and analyzes international legislative trends in defining the minimum age of criminal responsibility. The research concludes that, despite the progressmade in Algerian legislation, practical challenges—such as the limited implementation of alternative sanctions and institutional coordination—remain to be addressed."
