المسؤولية القانونية عن التلوث البيئي في التشريع الجزائري

Abstract

"The aim of fhis study is to focus legal liability for environmental pollution, This is by invoking criminal liability,whether it is the natural person’s responsibility for his own act or for the act of a third parry as well as liability of the kgel person,penal follow-up and liability impediments for environmcntal damge were also addreesed. Administrative responsibility is based on the concept of risk,it holds that if a public authority’s activity causes harm to an individual,even without any fault being committed,the authority is still obligated to compensate the injured party, provided that the damage is serious and specific.The mere existence of such risks is sufficient to establish this responsibility.In addition,administrative responsibility also imposes administrative sanctions to limit environmental pollution. Civil liability resulting from pollution and environmental damage by defining the legal system,and the penalty for civil liateility for environmental polluttion, the results of the study illuscrated the importance attached by Algerian legislation to the protection of the environment,of pollution ,one of the mose serious crimes the environnement Arnong the most important recummendations is the activation of the preventive and decerrcnt aspect,as well as the intensification of sensirization campaigne on the importance of environmental conservation."
